Am I covered if a tree from my property falls on my neighbor's fence?

Your homeowner insurance policy covers you for damages for which you are legally liable, subject to the policy’s terms and conditions. So if your tree falls and causes damage to your neighbor’s property, the claim adjuster will determine whether you are actually liable. In most cases, if an apparently healthy tree is blown down or struck by lightning, you will not be considered negligent and should not be responsible for indemnifying your neighbor. If, however, there was good reason to think the tree was likely to fall due to its age or condition, you might be considered liable. In this case, your policy will cover you up to the limit of liability coverage you carry. |
